Privacy Policy

1. Overview
This Privacy Policy explains how item (“item”, “we”, “us”) collects, uses, shares, and protects information about you when you use the item website, mobile application, and related services (the “Platform”). By using the Platform, you agree to the practices described here. This Policy is incorporated into our Terms of Service.
2. Information We Collect
You provide to us: account details (name, username, email, password), profile information (avatar, bio, shop name, location), listing content (titles, descriptions, photos, prices, condition, categories), messages you send, reviews you write, support requests, and any other information you choose to share.
Transaction information: shipping and billing addresses, order details, fulfillment status, pickup confirmation, tracking details, claim/dispute records, refund status, and limited payment metadata. Full payment card details are collected and stored by Stripe; we do not store full card numbers on our servers.
Seller verification: if you sell on item, Stripe collects identity, tax, and bank information directly from you to satisfy Know-Your-Customer (KYC), anti-money-laundering, and tax reporting requirements. Stripe shares with us a limited account status (e.g., charges enabled, payouts enabled) but not the underlying documents.
Automatically collected: device and browser information, IP address, approximate location derived from IP, app version, operating system, referring URLs, pages and screens viewed, actions taken, search/listing interactions, risk signals, and timestamps. We use cookies, local storage, and similar technologies for authentication, preferences, security, fraud prevention, and analytics.
From third parties: identity, fraud, dispute, payout, and risk signals from Stripe; delivery status, label, void, surcharge, and insurance/claim information from Shippo, carriers, and insurers; email engagement from our email provider; and any information you allow another service (such as a sign-in provider) to share with us.
3. How We Use Information
We use information to operate the Platform, including: creating and securing your account; displaying listings and shop pages; matching buyers and sellers; routing messages; processing transactions; generating shipping labels; sending transactional and service-related emails and notifications; preventing fraud, abuse, unsafe meetups, prohibited activity, chargeback abuse, account takeover, and marketplace risk; investigating disputes, insurance claims, reports, and policy violations; enforcing our Terms and marketplace policies; complying with legal obligations; and analyzing usage to improve the Platform. We do not sell your personal information.
4. How Information Is Shared
Between users. Profile information, shop name, listings, reviews, and (if enabled) approximate location are visible to other users and to the public. When you place an order, your shipping address is shared with the seller; when you sell, your shop name and message-thread identity are shared with the buyer. Messages, dispute details, claim evidence, tracking, and pickup/order information may be shared with the other party where needed to operate the transaction, resolve issues, or enforce our policies.
Service providers. We share information with vendors that help us operate the Platform, including: Stripe (payments, payouts, identity verification, disputes, fraud/risk review), Shippo, XCover, and carriers such as USPS, UPS, FedEx, and DHL (shipping labels, tracking, insurance, claims, voids, and carrier issues), Supabase (database, authentication, storage), Vercel (hosting and infrastructure), Resend (transactional email), and PostHog (product analytics). These providers process information on our behalf or as independent controllers under their own privacy policies.
Legal and safety. We may disclose information when we believe disclosure is required or appropriate to comply with applicable law, legal process, or government request; to enforce our Terms; to detect, prevent, or address fraud, security, or technical issues; or to protect the rights, property, or safety of item, our users, or the public.
Business transfers. If item is involved in a merger, acquisition, financing, reorganization, or sale of assets, your information may be transferred as part of that transaction.
With your consent. We may share information for any other purpose disclosed to you with your consent.
5. Cookies and Tracking
We use cookies and similar technologies to keep you signed in, remember your preferences, secure the Platform, and understand usage. Most browsers let you refuse cookies or alert you when cookies are sent; if you disable cookies, parts of the Platform may not function. We do not currently respond to browser “Do Not Track” signals.
6. Your Choices
You can review and update your profile and privacy preferences (including location visibility and whether your shop appears in browse and search) in your account’s privacy settings. You can opt out of non-transactional emails using the unsubscribe link in those emails. You may always close your account by emailing support@item.ec. Some communications are required for the Platform to function and cannot be opted out of while you maintain an account.
7. Your Rights
Depending on where you live, you may have the right to access, correct, delete, port, or restrict the processing of your personal information, and to object to certain processing. You may also have the right to lodge a complaint with a data protection authority. To exercise these rights, email support@item.ec from the address on file. We may verify your request before acting and may decline requests where permitted or required by law (for example, where retention is needed to comply with tax, dispute, or fraud-prevention obligations). California residents may exercise rights under the CCPA/CPRA, and we do not discriminate against users who exercise their rights.
8. Data Retention
We retain personal information for as long as your account is active and for a reasonable period thereafter to comply with legal obligations (including tax, accounting, payment, carrier, insurance, and dispute-resolution requirements), enforce our Terms, prevent fraud, investigate marketplace abuse, resolve disputes and claims, and maintain safety records. Some information (such as transaction records, messages, reports, claim evidence, dispute history, payout records, and content shared with other users) may persist after account closure for these purposes.
9. Security
We use reasonable administrative, technical, and physical safeguards to protect personal information, including encryption in transit and at rest where appropriate, access controls, and vendor due diligence. No method of transmission or storage is completely secure, however, and we cannot guarantee the security of any information you provide.
10. Children
The Platform is not intended for anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact support@item.ec and we will take appropriate steps to delete it.
11. International Users
item is operated from the United States. If you access the Platform from outside the United States, your information will be transferred to, stored, and processed in the United States and other countries where our service providers operate. By using the Platform, you consent to that transfer.
12. Third-Party Links and Services
The Platform may link to or integrate with third-party services (including Stripe, Shippo, and the underlying carriers). Their handling of your information is governed by their own privacy policies. We are not responsible for the practices of those third parties.
13. Changes to This Policy
We may update this Privacy Policy from time to time. The “Effective” date above will reflect the latest version. Material changes will be communicated through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Policy.
